WHAT’S THE WAIVER FOR BROKERAGE CONTRACTS ALL ABOUT?

I am looking for a property. What's the waive of the 14-day right of withdrawal when contacting a real estate agent all about?

According to § 4 paragraph 1 number 8 FAGG (Fern- und Auswärtsgeschäftegesetz) the real estate agent has comprehensive information requirements. This also includes the information on the 14-day right of withdrawal concerning the brokerage contract or the loss of that right, when the service starts immediately. In the areas of rental or purchase of a property it's usually not on behalf of the consumer to wait 14 days to view the apartment, that's why one has to waive the right of withdrawal towards the real estate agent. Nevertheless, the obligation to pay commission only starts when the property has been mediated successfully.

THE REAL ESTATE AGENT WANTS A WRITTEN ORDER – CAN’T HE JUST LOOK AROUND FOR INTERESTED PARTIES

You don't want to sell your property just "orally" but rather have a written contract with the buyer of the property. Or you also don't want to rent out your apartment just "orally", what would be even possible, but might lead to e.g. indefinite rental contracts.

Only by having an exclusive brokerage agreement your real estate agent is obligated to become active. General, oral contracts are often left behind and won't lead to success.
