You often read the term " commission-free" or " from private" in real estate advertisements.
In the headlines one can read about the term Commission when it actually refers to bribe payments that are relevant under criminal law. The charging of a commission - strictly regulated by law - in connection with real estate transactions is almost exclusively reserved for the Berfus group of real estate agents after the conclusion of a brokerage contract (also conclusive) and in the case of so-called meritorious activity (real estate agent's commission). The term commission-free is often used by professional groups that are not allowed to charge a real estate agent's commission per se - i.e. by law - e.g. by individual property developers for residential construction projects or commercial projects. If the term " commission-free " is used within the professional group of real estate agents, this may constitute a violation of the Trade and Real Estate Agent Ordinance and may also constitute a violation of the UWG (Federal Act against Unfair Competition). However, so-called private persons also like to advertise with the attribute commission-free or with private sale. But what is a private sale of real estate? The commercial real estate agent is also privately (economically) or privately (legally) active - in contrast to corporations under public law, which alone can be publicly and thus sovereignly active. Thus, your real estate agent will also act privately in the very literal sense of the word, namely from e.g. personally taking care of the brokerage of your property.
